Federal and state laws require that if at the time of an accident you are Medicare and/or Medicaid eligible, you must report the accident to Medicare and/or Medicaid to confirm that neither has made accident related payments for you. This is the case even if you know that you have not used Medicare or Medicaid to pay for any of your accident related treatment. Consequently, any settlement you reach cannot be finalized until Medicare and/or Medicaid has confirmed whether or not it has made accident related payments.
